Dispute an Expiation

A person who has received an expiation for an alleged offence may apply to Council for a review of the decision before the due date on the original expiation.  Council will assess the request in accordance with Council's Withdrawal of Expiation Notice Policy 20.63.2.

How to get a review of the decision?

To request Council to review the decision the person must complete the Review of Decision Application 20-71-T67 and provide evidence to substantiate the information provided in the Statement of Appeal section of the form before the due date on the original expiation.

You will be advised by Council of the outcome once a decision has been made.

If you are not satisfied with the outcome of the appeal, you are entitled to lodge a second appeal which will be assessed by another party.  Once a decision has been made you will be notified in writing of the outcome. 

Verbal requests to waive an expiation will not be considered. 

Can I arrange to make part payments?

What if I was not the driver?

If you have received an expiation for a vehicle offence and you were not the driver at the time, you will need to complete a statutory declaration and forward to council either by:

How long do I have before I have to pay my expiation?

If you have received an Expiation Notice for an alleged offence you are required to make payment within 28 days from (and including) the date of the notice unless an arrangement has been entered into under section 20 of the Fines Enforcement and Debt Recovery Act 2017.

Council provides the following services for the payment of your expiation:

  • Payment through the mail - by posting a cheque with the tear off remittance advice to City of Port Lincoln, PO Box 1787, Port Lincoln SA 5606.
  • Payment in person - at the City of Port Lincoln Council Administration Office, Level One, Civic Centre, 60 Tasman Terrace, Port Lincoln - Cheque, cash and EFTPOS facilities are available Monday to Friday 9am to 5pm.
  • Pay with your credit card via Council website www.portlincoln.sa.gov.au/makeapayment at anytime.
