Elected Member Registers

Pursuant to Section 7 of the Local Government (General) Regulations 2013 for the purposes of Section 63(1) of the Local Government Act 1999, the Code of Conduct for Council Members is adopted as a code of conduct to be observed by the members of all Councils.

For the purposes of Clause 3.10 of the Code of Conduct, where a Council member receives a gift or benefit, details of each gift or benefit must be recorded within a gifts and benefits register.  The threshold amount governing when a gift or benefit must be registered has been gazetted at $100.  The register will be updated on a quarterly basis.

The Gifts & Benefits Register is available for inspection (without charge) at the Council Office and an extract can be obtained on payment of a fee fixed by Council.

Register of Interest - Members (Section 68)

Pursuant to Section 68 of the Local Government Act 1999, Elected Members are to complete a declaration on an annual basis containing details of their interests.  Council is required to publish on its website, in accordance with the regulations, the following details in relation to each member of the council contained in the Register:

(a)   the member's income sources (within the meaning of Schedule 3) or employer;
(b)   the name of any political party, any body or association formed for political purposes or any trade or professional organisation (within the meaning of Schedule 3) of which the member is a member;
(c)   any gifts recieved by the member that are required to be included in the information entered in the Register in relation to the member.

Register of Interest - Council Members

The full Register of Interests is available for inspection (without charge) at the Council Office and an extract can be obtained on payment of a fee fixed by Council. 

Register of Conflict of Interest (Section 73, 74, 75 & 75A)

Pursuant to Section 73 and 74 of the Local Government Act, 1999 the Council must publish on its website the following details, in accordance with the regulations, if a member of Council discloses a material conflict of interest in a matter to be discussed at a meeting of the Council:

(a)   the member's name;
(b)   the nature of the interest, as described by the member;
(c)   if the member took part in the meeting, or was in the chamber during the meeting, under an approval under subsection (3), the fact that the member took part in the meeting, or was in the chamber during the meeting (as the case requires). 

Pursuant to Section 75 and 75A of the Local Government Act, 1999 the Council must publish on its website the following details, if a member of council discloses an actual or perceived conflict of interest in a matter to be discussed at a meeting of Council:

(a)   the member's name;
(b)   the nature of the interest, as described by the member;
(c)   the manner in which the member dealt with the actual or perceived conflict of interest;
(d)   if the member votted on the matter, the manner in which he or she voted;
(e)   the manner in which the majority of persons who were entitled to vote at the meeting voted on the matter.

The Register of Conflict of Interest is available for inspection (without charge) at the Council office and an extract can be obtained on payment of a fee fixed by Council.

Register of Members Allowances & Benefits (Section 79)

Pursuant to Section 79 of the Local Government Act 1999, the Council must keep a Register of Allowances and Benefits, in accordance with principles (if any) prescribed by the regulations, in respect of each member of the council:

(a)   the annual allowance payable to the member; and
(b)   details of any expenses reimbursed by the council under section 77(1)(b); and
(c)   details of other benefits paid or payable to, or provided for the benefit of, the member of the Council.

The Register of Members Allowance and Benefits can be inspected (without charge) at the Council Office and an extract can be obtained on payment of a fee fixed by Council.
